First: when and how was the claim served?
Preserve the envelope, proof of service, and every accompanying notice. The period generally begins upon valid service, and the type of proceeding determines the applicable deadline. According to the Israel Courts Administration's public service information, a defense is generally due within 60 days in an ordinary proceeding, 45 days in an expedited proceeding, and 30 days in a small-claims case or an expedited eviction action; a longer period applies in medical-malpractice litigation. The actual docket and orders must be checked rather than relying only on a general rule.
Collect evidence before drafting
Contracts, receipts, correspondence, photographs, recordings, and a list of possible witnesses should be assembled. Information should not be deleted and documents should not be altered. A chronology should identify which allegations are admitted, which are denied, and which require explanation.
Preliminary issues
Jurisdiction, limitation, the identity of the parties, service, forum-selection provisions, and whether the claim includes the documents on which it relies should be examined. A preliminary defense not raised at the proper time may be weakened or treated as abandoned.
A defense is not an informal response letter
The allegations should be addressed clearly and by numbered paragraph, the defendant's account should be stated, and documents should be attached in accordance with the procedural rules. A general denial is not a substitute for a factual account when the relevant facts are within the defendant's knowledge.
Is there a counterclaim?
A defendant may have an independent claim against the plaintiff. Whether to assert it as a counterclaim or in a separate action should be examined in light of jurisdiction, filing fees, and the relationship between the disputes.
