Creditor Representation

Representation of creditors in insolvency, enforcement, debt-proof, security, and recovery proceedings.

Focused representation under Israeli law

The legal analysis begins with the facts, the available record, and the procedural posture. In matters involving creditor representation, early decisions may shape the evidence, the available remedies, and the course of the proceeding.

The firm represents clients before Israeli courts, investigative authorities, enforcement agencies, and other competent bodies. Advice is tailored to the individual matter; it is not based on a one-size-fits-all formula.

Representative matters

The scope of representation may include the following:

  • Filing and defending proofs of debt
  • Secured claims and collateral
  • Creditor applications to commence proceedings
  • Objections to discharge, voidable transactions, and distributions

How the matter is handled

A disciplined process helps preserve options and keeps the client informed at each material stage.

  • Verify the debt and supporting documents
  • Calendar every filing and objection deadline
  • Analyze priority, security, guarantees, and related proceedings
  • Choose a proportionate recovery strategy based on available assets

An individual legal assessment

No two cases are identical. The applicable strategy depends on the evidence, deadlines, jurisdiction, prior proceedings, and the practical effect of the dispute on the client’s life or business.

Frequently asked questions

Does an enforcement file continue normally after a commencement order?

A commencement order changes the collection framework. The order must be reviewed and action taken within the insolvency proceeding.

How long is there to file a proof of debt?

According to the Commissioner's official information, the statutory period is six months from publication of the commencement order. A late filing requires consideration of an extension request.

What accompanies a proof of debt?

Documents proving the source of the obligation, the balance, payments, interest, expenses, and security, according to the type of debt.

Must a secured creditor file a proof of debt?

The security and the creditor's intended course in the proceeding must be examined. A creditor should not assume that the lien eliminates every reporting or procedural requirement.
