Delayed Sexual-Offense Complaint: Evidence and Limitation Periods

A complaint may be filed long after an alleged event. Delay neither resolves truth nor bars every investigation, but it can affect evidence, the ability to defend, and the limitation analysis.

Can an old complaint be investigated?

Yes. Investigation and lawful prosecution are distinct questions; charge, dates, age, relationship, and transition provisions must be identified.

Is delay inherently less credible?

No. Fear, shame, dependency, family or authority relationships, and trauma may explain delay, while the account must still be tested normally.

Effect on evidence

Memory may fade and messages, devices, cameras, location data, medical material, work records, and witnesses may become unavailable.

Early disclosure evidence

Investigators examine whom the complainant told, when, the exact words, and whether the witness learned later versions.

Material inconsistencies

The focus is on changes affecting identity, act, consent, place, time, and surrounding circumstances, with attention to explanations and objective records.

The 2026 amendment

Amendment 155, effective June 30, 2026, extended limitation rules for certain sexual offenses against minors; its application depends on the precise offense and transition provisions.

Age alone is insufficient

The offense, maximum penalty, event date, victim's age, family or authority relationship, prior investigative acts, and statutory amendments all matter.

Questioning about an old event

Do not fill memory gaps by guessing; lawfully locate calendars, messages, photos, receipts, work and travel records, and potential witnesses.

Defense review

Examine first disclosure, evolution of accounts, remaining objective material, investigative omissions, concrete evidentiary prejudice, limitation, and specificity of questioning.

Does prejudice require closure?

Not automatically. The missing evidence and its likely significance must be shown concretely.

What must not be done

Do not contact the complainant to seek withdrawal, coordinate witnesses, delete data, publish identifying details, impersonate anyone, or access accounts unlawfully.

Summary

A delayed complaint requires sensitive, precise evidentiary review and a separate, offense-specific limitation analysis.
